1. Acceptance of Terms

By accessing or using MythMaker AI ("Service", "we", "us", or "our"), provided by EmeraldSoft, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not access or use the Service.

2. Eligibility and Account Responsibilities

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use our Service. You are responsible for safeguarding your account credentials, maintaining the confidentiality of your login information, and for all activities that occur under your account.

3. Prohibited Content and Acceptable Use Policy

MythMaker AI is designed to foster creativity, storytelling, and imaginative worldbuilding. To ensure a safe, respectful, and wholesome environment for all creators and readers (including families and younger audiences), you strictly agree NOT to generate, upload, share, prompt, or distribute content that includes:

• Adult, Explicit, or Sexually Suggestive Content: Any sexually explicit material, pornography, depictions of sexual violence, non-consensual sexual content, or sexually suggestive depictions of minors (Child Sexual Abuse Material / CSAE has zero tolerance and will be reported immediately to law enforcement).
• Hate Speech and Racism: Any content that promotes racism, white supremacy, antisemitism, xenophobia, bigotry, or discrimination, or that incites hatred or violence against individuals or groups based on race, ethnicity, nationality, religion, disability, age, sexual orientation, or gender identity.
• Graphic Violence and Gore: Senseless, gratuitous, or realistic depictions of extreme violence, gore, torture, bodily harm, animal abuse, or self-harm encouragement.
• Harassment, Bullying, and Defamation: Content intended to harass, stalk, threaten, demean, defame, impersonate, or intimidate real individuals or groups.
• Illegal Activities and Harmful Instruction: Instructions or encouragement for illegal acts, terrorism, bomb-making, cyberattacks, malware distribution, human trafficking, fraud, or drug manufacturing.
• Copyright and Intellectual Property Infringement: Content, characters, or text that infringes on the trademarks, copyrights, trade secrets, or proprietary rights of third parties without explicit authorization.

4. Content Moderation & Right of Removal

EmeraldSoft and MythMaker AI reserve the absolute right, at our sole discretion, to:

• Automated & Manual Review: Pre-screen, filter, monitor, or review any user prompts, generated stories, characters, and images using automated AI safety guardrails and manual administrative review.
• Immediate Content Removal: Delete, unpublish, modify, or permanently remove any story, character, prompt, or user-submitted asset that we determine, in our sole judgment, violates these Terms, our Acceptable Use Policy, or applicable law, without prior notice.
• Account Sanctions: Issue warnings, temporarily restrict features, or permanently suspend/ban accounts found to be generating or distributing prohibited content, with no refund of remaining credits or subscription fees.
• No Liability for Moderation: We do not assume liability for failing to detect, edit, or remove objectionable content submitted or generated by third parties, but we will act promptly upon receiving credible abuse reports.

5. Intellectual Property & User Content

Subject to your compliance with these Terms, you retain ownership rights to the original stories, characters, and text created through your active prompts on MythMaker AI. EmeraldSoft retains all rights, title, and interest in and to the platform, proprietary algorithms, website design, UI, trademarks, and system assets.

By publishing stories or creating public library elements (characters, locations, items) on MythMaker AI, you grant EmeraldSoft a non-exclusive, worldwide, royalty-free license to display, host, format, and share such public content on the platform.

6. Subscriptions, Credits, and Payments

Certain features, generation tiers, and higher chapter limits require credits or active subscription plans. Payments are processed securely via third-party payment providers (e.g., Stripe). All fees and credit purchases are non-refundable except where required by law. Unused credits cannot be exchanged for cash.

7. Termination and Account Deletion

We may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice or liability. You may also request deletion of your account at any time by contacting our support team.

8. Disclaimer and Limitation of Liability

MythMaker AI is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for high quality and kid-friendly storytelling, AI models may occasionally generate unexpected, inaccurate, or unintended output. In no event shall EmeraldSoft, its founders, employees, or partners be liable for any indirect, consequential, punitive, or incidental damages arising out of your use of or inability to use the Service.

9. Reporting Violations & Contact

If you discover any content or behavior on MythMaker AI that violates these Terms or our Prohibited Content Policy, please report it immediately through our Contact Page. We review all reports promptly.
